Furthermore, if there is a discrepancy between information posted on the Service and the Bassett Street Condominium Declaration/Bylaws/Rules & Regulations, and/or if applicable, provisions of the Rhode Island Condominium Act, it will be the information in the Declaration/Bylaws/Rules & Regulations that will prevail.

Any user ID and password you may have for this Website are confidential and you must maintain confidentiality as well.
CONDUCT
In your digital interactions with other users (including but not limited to: site messages, journal postings, comments, and work orders), you agree to conduct yourself civilly and respectfully. While using the Website, you agree that you shall not under any circumstances harass or make mischief against any other user of the Website. The Board of Directors of the Bassett Street Condominium Association reserves the right to determine, at its sole discretion, what constitutes harassment or mischief, and where that has occurred; and may, also at its sole discretion, partially or completely deny service to any infringing party. As part of these efforts, the Board of Directors may enlist the help of its active users to moderate flagged messages, comments and other content to determine if a user’s conduct is harmful to the community. Bassett Street Unit Owners, where applicable, with regard to their use of this website, data or domain name, shall be responsible for the conduct, including acts and omissions, of their family members, friends, tenants, occupants, licensees, agents, representatives, invitees and the like who use this website, data and domain name.
CHANGES
The Bassett Street Condominium Association reserves the right to update and change the Terms of Service from time to time without notice. New features that upgrade or enhance the Service, including new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
OWNERSHIP OF DATA
You agree that all data, messages, records, and reports relating the Service shall be considered exclusive property of the Bassett Street Condominium Association. The Bassett Street Condominium Association shall own the website, data thereon and the domain name. Any unauthorized use of such website, data and/or domain name shall subject the offending user to the assessment, fine and penalty provisions set forth in the Bassett Street Condominium’s governing documents as well as the Rhode Island Condominium Act. The Board of Directors, may, at its sole discretion, take the website down, but its ownership interest therein, the data therein and the domain name therefor shall remain its property in perpetuity.
NO WARRANTIES
This Website is provided “as is,” with all faults, and the Bassett Street Condominium Association express no representations or warranties, of any kind related to this Website or the materials contained on this Website. Also, nothing contained on this Website shall be interpreted as advising you.
LIMITATION OF LIABILITY
The Bassett Street Condominium Association, including its officers, directors and employees shall not be held liable for any indirect, consequential or special liability arising out of or in any way related to your use of this Website.
INDEMNIFICATION
You hereby indemnify, to the fullest extent, the Bassett Street Condominium Association from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.
SEVERABILITY
If any provision of these Terms is found to be invalid under any applicable law, such provision shall be deleted without affecting the remaining provisions herein.
ASSIGNMENT
The Bassett Street Condominium Association may assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
ENTIRE AGREEMENT
These Terms constitute the entire agreement between the Bassett Street Condominium Association and you in relation to your use of this Website, and supersede all prior agreements and understandings.
GOVERNING LAW & JURISDICTION
These Terms will be governed by and interpreted in accordance with the laws of the State of Rhode Island including, but not limited to the Rhode Island Condominium Act, the Declaration, Bylaws, Rules and Regulations (as amended) of the Bassett Street Condominium Association, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Rhode Island for the resolution of any disputes.
